How the Virginia Online Divorce Process Works

Before you start an online divorce in Virginia, you must meet the Commonwealth’s residency requirements. At least one of the spouses must have lived in Virginia and be domiciled for at least six months. Being a resident means you have a permanent home in the Commonwealth. Being domiciled means you have the intention of living in Virginia indefinitely. For example, someone in the armed services may reside in another state for the duration of a “tour” of several years but is domiciled in Virginia. That person intends to move back to and stay in Virginia.

Once you meet the residency requirements, you must:

  1. Review the divorce forms.
  2. Enter into a signed separation agreement that addresses child custody, division of property, child support, spousal support, and any other issues that pertain to you.
  3. Complete, sign, and notarize (if applicable) the divorce paperwork.
  4. File for divorce.

If your spouse is willing to sign the Waiver and Acceptance of Service, we file it along with the Moving Party Affidavit (signed by you), the Final Decree of Divorce, and the divorce papers to change your marital status with Vital Statistics.

How Long Does an Uncontested Divorce Take?

After you have been separated for the required duration of time, you can file for divorce. Uncontested divorces usually happen quickly, taking an average of a few months.

Does Virginia Allow No-Fault Divorce?

Yes, Virginia allows for no-fault divorce. The only no-fault ground is separation – you must prove that you lived separate and apart with no sexual relationship (cohabitation) for at least one year.

If you have a separation agreement and do not have children, you can ask the court to shorten the separation time to six months.

It also allows for fault-based divorce. You can allege faults, including:

  • Adultery
  • Sodomy
  • Conviction of a felony
  • Abandonment/willful desertion
  • Cruelty
What is the Process for Changing Your Name After Divorce?

If you are filing for an uncontested divorce, it is a simple matter of adding a paragraph to your Petition for Dissolution of Marriage. If you are filing a contested divorce, you will not be able to file a divorce online or request a name change online.
