While Virginia does allow you to file an online divorce, it must be uncontested – both parties must agree to all family law matters, including division of property, time-sharing, child support, and spousal support.
If you cannot agree on just one matter, you will have to file a contested divorce. You can still sign a settlement agreement for the other issues, but because the divorce is contested, it must be done in person. The court incorporates any partial agreement into the final judgment.

A divorce with a name change is for those who changed their name when they married and want to revert to their previous legal name once the divorce becomes final. If you are undecided about changing your name, you can always do it after the divorce.
Those who want to change their name can change it prior to the divorce; however, changing your name during the divorce is easier than doing it prior to the divorce – it’s a simple step in the divorce process.
During the divorce process, request a name change in the Complaint for Divorce. We’ll submit the Order for Name Change along with the Final Decree of Divorce and the other documents required by the court to finalize the procedure.
If the court approves of the name change, it enters the Order for Name Change and forwards the appropriate paperwork to Vital Statistics.
Depending on your situation, the adoption process could take anywhere from several months to over a year. Adopting a child always requires a waiting period. The custodial agency assesses the strengths of all interested families and decides which family can best meet the child’s individual needs. Time frames are not predictable, as it frustrates families who are prepared to adopt.
