Types of Protective Orders in Virginia
In Virginia, there are three types of protective orders victims of abuse can pursue.
- Emergency Protective Orders (EPO) are designed to provide alleged victims immediate protection from the dangerous acts of their abuser as outlined under Va Code § 16.1-253.4. They expire at the end of the third day or the next day a court session is held, whichever is later. Either you or a law enforcement representative can request the order.
- Preliminary Protective Orders are an option under Va. Code § 16.1-253.1(B). The first step to obtaining a permanent protective order against an abuser before a full hearing takes place, the order is in effect for up to 15 days. While providing similar protections as the emergency order, a key difference is you must file for this order in writing yourself.
- A final Protective Order (PPO), as stipulated by Va. Code § 16.1-279.1(B), may be granted by a judge after a full court hearing takes place. A PPO can last up to two years or longer if an extension is filed before the order expires.
Where Do I Request a Protective Order in Norfolk?
Your relationship with the person hurting you determines where you should file for a protective order. If the person is family, a household member, or under the age of 18, you can file at the Juvenile and Domestic Relations District Court. Other requests for protective orders not meeting this criteria should file with the General District Court.
How Do Protective Orders Affect Custody in Norfolk?
